2.1 These Terms of Service ("Terms") govern all use of the Import8 platform, website, and API (collectively, the "Service") operated by Trade8 B.V. ("we", "us", "our").
2.2 The Service is intended exclusively for business users (B2B). By registering an account, accessing the API, or otherwise using the Service, you confirm that you are acting in the course of your business or profession and that you accept these Terms in full.
2.3 If you do not agree with any part of these Terms, you may not use the Service.
3.1 Core Service: Import8 provides AI-powered customs classification suggestions for products entering the European Union. The platform accepts product descriptions and images and returns HS (Harmonized System) tariff code suggestions with confidence levels and transparent reasoning.
3.2 Best Effort — Not Legally Binding: All classifications are provided on a best effort basis and are not legally binding. While we strive for the highest possible accuracy, we cannot guarantee that every classification is correct or complete. You are responsible for verifying classifications before using them for customs declarations, import/export documentation, or any other official purpose. We strongly recommend consulting a licensed customs broker or the relevant customs authority for definitive classification rulings.
3.3 AI Transparency: The Service uses artificial intelligence to generate classification suggestions. In accordance with the EU AI Act (Regulation 2024/1689), we inform you that: (a) classifications are generated by AI models, not by human customs experts; (b) the AI system has inherent limitations and may produce incorrect results; and (c) a qualified human must always make the final classification decision. The AI system is based on the official EU Combined Nomenclature and TARIC database, General Rules for the Interpretation of the Harmonized System (GRI), European Binding Tariff Information (EBTI) precedent rulings, and machine learning analysis.
3.4 Multiple Results: When the system cannot determine a single classification with high confidence, it may provide multiple candidate codes with probability percentages, allowing you to make an informed decision.
3.5 Input Quality: The accuracy of classifications depends significantly on the quality and completeness of the information provided, including product descriptions, images, material composition, and intended use. Incomplete or vague descriptions may result in reduced accuracy or multiple possible classifications.
4.1 Account registration requires a company name, email address, and password. By registering, you confirm that the information provided is accurate and complete and that you are authorized to act on behalf of your organization.
4.2 You are responsible for maintaining the confidentiality of your account credentials and API keys. You must immediately notify us of any unauthorized account access.
4.3 Organization accounts may have multiple users depending on the subscription plan. You are responsible for all activities conducted under your organization account by any authorized user.
4.4 We reserve the right to suspend or terminate accounts that violate these Terms, fail to make payments, or engage in fraudulent or unlawful activities. Upon termination, access to the Service will be revoked immediately.
5.1 Import8 offers multiple subscription plans with varying classification volumes, API keys, and rate limits. Current pricing and plan details are available on our pricing page.
5.2 Classifications exceeding the monthly allowance will be charged at the overage rate specified in your plan. Overage usage is metered and billed automatically at the end of each billing cycle.
5.3 All payments are processed through Stripe. By subscribing to a paid plan, you authorize recurring charges to your payment method. All prices are in EUR and exclusive of VAT.
5.4 Subscription fees are non-refundable. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No pro-rata refunds are issued for partial periods.
6.1 We process personal data in accordance with the EU General Data Protection Regulation (GDPR). Our Privacy Policy describes in detail what data we collect, why, and on what legal basis.
6.2 Data for System Improvement: We use aggregated and anonymized classification data, including corrections and confirmations provided by users, to improve the accuracy of our classification system. This processing is based on our legitimate interest (Article 6(1)(f) GDPR) in improving the Service. No individual product data is shared with third parties for this purpose.
6.3 Third-Party AI Processing: Product descriptions and images submitted for classification are processed by third-party AI providers (currently Anthropic, based in the United States). This transfer is governed by Standard Contractual Clauses (SCCs) in accordance with GDPR Chapter V. Anthropic processes data solely on our instructions and does not use your data for its own training purposes.
6.4 Data Retention: Classification results and associated product data are retained for the duration of your account. After account deletion, data is retained for a maximum of twelve (12) months for legal and operational purposes, after which it is permanently deleted. You may request earlier deletion in accordance with the rights described in our Privacy Policy.
7.1 The Service is provided "as is" and "as available". We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the classifications for any particular purpose.
7.2 To the maximum extent permitted by Dutch law, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from: (a) incorrect or incomplete classifications; (b) customs duties, penalties, fines, or surcharges resulting from the use of our classifications; (c) delays in customs clearance or shipment processing; or (d) any decisions made based on classifications provided by the Service.
7.3 Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim.
8.1 You must provide accurate and complete product information for classification and verify all classifications before use in official customs documentation.
8.2 You may not use the Service for any unlawful purpose, including but not limited to customs fraud, duty evasion, or the classification of prohibited goods.
8.3 You may not exceed the classification limits or rate limits of your subscribed plan, and you may not attempt to reverse-engineer, decompile, scrape, or extract the classification algorithms or underlying data.
The Service, including its classification algorithms, user interface, documentation, and EBTI rule database, is the intellectual property of Trade8 B.V. You retain ownership of the product data you submit and the classification results generated for your account.
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: outages or disruptions at third-party providers (including AI and hosting providers), internet failures, power outages, government actions, natural disasters, or cyberattacks.
We may update these Terms from time to time. We will notify you of material changes at least thirty (30) days in advance via email or through the Service. If you do not agree with the updated Terms, you may terminate your account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or the use of the Service shall be submitted exclusively to the competent court in Groningen, the Netherlands.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

2.1 Deze Algemene Voorwaarden ("Voorwaarden") zijn van toepassing op al het gebruik van het Import8 platform, de website en de API (gezamenlijk de "Dienst"), beheerd door Trade8 B.V. ("wij", "ons", "onze").
2.2 De Dienst is uitsluitend bestemd voor zakelijke gebruikers (B2B). Door een account aan te maken, toegang te krijgen tot de API of anderszins gebruik te maken van de Dienst, bevestigt u dat u handelt in het kader van uw beroep of bedrijf en dat u deze Voorwaarden volledig aanvaardt.
2.3 Indien u niet akkoord gaat met enig onderdeel van deze Voorwaarden, mag u de Dienst niet gebruiken.
3.1 Kerndienst: Import8 biedt AI-gestuurde classificatiesuggesties voor producten die de Europese Unie binnenkomen. Het platform accepteert productbeschrijvingen en afbeeldingen en retourneert GS-tariefcodesuggesties (Geharmoniseerd Systeem) met betrouwbaarheidsniveaus en transparante onderbouwing.
3.2 Best Effort — Niet Juridisch Bindend: Alle classificaties worden geleverd op basis van best effort en zijn niet juridisch bindend. Hoewel wij streven naar de hoogst mogelijke nauwkeurigheid, kunnen wij niet garanderen dat elke classificatie correct of volledig is. U bent zelf verantwoordelijk voor het verifiëren van classificaties alvorens deze te gebruiken voor douaneaangiften, import-/exportdocumentatie of andere officiële doeleinden. Wij raden sterk aan om een erkend douane-expediteur of de relevante douaneautoriteit te raadplegen voor definitieve indelingsbeslissingen.
3.3 AI-Transparantie: De Dienst maakt gebruik van kunstmatige intelligentie voor het genereren van classificatiesuggesties. Conform de EU AI-verordening (Verordening 2024/1689) informeren wij u dat: (a) classificaties worden gegenereerd door AI-modellen, niet door menselijke douane-experts; (b) het AI-systeem inherente beperkingen heeft en onjuiste resultaten kan produceren; en (c) een gekwalificeerd persoon altijd de definitieve classificatiebeslissing dient te nemen. Het AI-systeem is gebaseerd op de officiële EU Gecombineerde Nomenclatuur en TARIC-database, Algemene Regels voor de Interpretatie van het Geharmoniseerd Systeem (GRI), Europese Bindende Tariefinlichtingen (EBTI) en machine learning-analyse.
3.4 Meerdere Resultaten: Wanneer het systeem niet met hoge zekerheid een enkele classificatie kan vaststellen, kunnen meerdere kandidaatcodes met waarschijnlijkheidspercentages worden aangeboden, zodat u een geïnformeerde beslissing kunt nemen.
3.5 Kwaliteit van Invoer: De nauwkeurigheid van classificaties hangt in belangrijke mate af van de kwaliteit en volledigheid van de aangeleverde informatie, waaronder productbeschrijvingen, afbeeldingen, materiaalsamenstelling en beoogd gebruik. Onvolledige of vage beschrijvingen kunnen leiden tot verminderde nauwkeurigheid of meerdere mogelijke classificaties.
4.1 Voor registratie zijn een bedrijfsnaam, e-mailadres en wachtwoord vereist. Door u te registreren bevestigt u dat de verstrekte informatie juist en volledig is en dat u bevoegd bent om namens uw organisatie te handelen.
4.2 U bent verantwoordelijk voor het vertrouwelijk houden van uw accountgegevens en API-sleutels. U dient ons onmiddellijk op de hoogte te stellen van ongeautoriseerde toegang tot uw account.
4.3 Organisatieaccounts kunnen meerdere gebruikers hebben, afhankelijk van het abonnement. U bent verantwoordelijk voor alle activiteiten die onder uw organisatieaccount worden uitgevoerd door geautoriseerde gebruikers.
4.4 Wij behouden ons het recht voor om accounts op te schorten of te beëindigen die deze Voorwaarden schenden, betalingen niet voldoen of zich schuldig maken aan frauduleuze of onwettige activiteiten. Bij beëindiging wordt de toegang tot de Dienst onmiddellijk ingetrokken.
5.1 Import8 biedt meerdere abonnementsplannen met uiteenlopende classificatievolumes, API-sleutels en snelheidslimieten. Actuele prijzen en plandetails zijn beschikbaar op onze prijzenpagina.
5.2 Classificaties die het maandelijkse tegoed overschrijden, worden in rekening gebracht tegen het overschrijdingstarief zoals vermeld in uw plan. Overschrijdingsgebruik wordt automatisch gemeten en gefactureerd aan het einde van elke facturatieperiode.
5.3 Alle betalingen worden verwerkt via Stripe. Door u te abonneren op een betaald plan autoriseert u terugkerende afschrijvingen van uw betaalmethode. Alle prijzen zijn in EUR en exclusief btw.
5.4 Abonnementskosten worden niet gerestitueerd. U kunt uw abonnement op elk moment opzeggen; de opzegging gaat in aan het einde van de lopende facturatieperiode. Er vindt geen restitutie plaats voor gedeeltelijke perioden.
6.1 Wij verwerken persoonsgegevens in overeenstemming met de Algemene Verordening Gegevensbescherming (AVG). Ons Privacybeleid beschrijft in detail welke gegevens wij verzamelen, waarom, en op welke rechtsgrond.
6.2 Gegevens voor Systeemverbetering: Wij gebruiken geaggregeerde en geanonimiseerde classificatiegegevens, inclusief correcties en bevestigingen van gebruikers, om de nauwkeurigheid van ons classificatiesysteem te verbeteren. Deze verwerking is gebaseerd op ons gerechtvaardigd belang (artikel 6 lid 1 sub f AVG) bij het verbeteren van de Dienst. Individuele productgegevens worden hiervoor niet gedeeld met derden.
6.3 Verwerking door Derden: Productbeschrijvingen en afbeeldingen die worden ingediend voor classificatie worden verwerkt door externe AI-providers (momenteel Anthropic, gevestigd in de Verenigde Staten). Deze doorgifte is geregeld middels Standard Contractual Clauses (SCCs) conform hoofdstuk V van de AVG. Anthropic verwerkt gegevens uitsluitend in onze opdracht en gebruikt uw gegevens niet voor eigen trainingsdoeleinden.
6.4 Bewaartermijn: Classificatieresultaten en bijbehorende productgegevens worden bewaard gedurende de looptijd van uw account. Na verwijdering van uw account worden gegevens maximaal twaalf (12) maanden bewaard voor juridische en operationele doeleinden, waarna ze definitief worden verwijderd. U kunt eerder verwijdering verzoeken conform de rechten beschreven in ons Privacybeleid.
7.1 De Dienst wordt geleverd "as is" en "as available". Wij geven geen garanties, uitdrukkelijk noch stilzwijgend, met betrekking tot de nauwkeurigheid, volledigheid, betrouwbaarheid of geschiktheid van de classificaties voor enig specifiek doel.
7.2 Voor zover toegestaan naar Nederlands recht zijn wij niet aansprakelijk voor enige indirecte, incidentele, bijzondere, gevolg- of voorbeeldschade voortvloeiend uit: (a) onjuiste of onvolledige classificaties; (b) douanerechten, boetes, sancties of toeslagen als gevolg van het gebruik van onze classificaties; (c) vertragingen bij douaneafhandeling of zendingsverwerking; of (d) beslissingen genomen op basis van door de Dienst geleverde classificaties.
7.3 Onze totale aansprakelijkheid voor claims voortvloeiend uit of gerelateerd aan de Dienst bedraagt niet meer dan het totaal aan vergoedingen door u betaald in de twaalf (12) maanden voorafgaand aan de gebeurtenis die aanleiding gaf tot de claim.
8.1 U dient nauwkeurige en volledige productinformatie aan te leveren voor classificatie en alle classificaties te verifiëren alvorens ze te gebruiken in officiële douanedocumentatie.
8.2 U mag de Dienst niet gebruiken voor onwettige doeleinden, waaronder maar niet beperkt tot douanefraude, ontduiking van rechten of de classificatie van verboden goederen.
8.3 U mag de classificatielimieten of snelheidslimieten van uw abonnement niet overschrijden, en u mag niet trachten de classificatie-algoritmen of onderliggende gegevens te reverse-engineeren, decompileren, scrapen of te extraheren.
De Dienst, inclusief classificatie-algoritmen, gebruikersinterface, documentatie en EBTI-regeldatabase, is het intellectueel eigendom van Trade8 B.V. U behoudt eigendom over de productgegevens die u indient en de classificatieresultaten die voor uw account worden gegenereerd.
Wij zijn niet aansprakelijk voor het niet of niet-tijdig nakomen van onze verplichtingen indien dit het gevolg is van omstandigheden buiten onze redelijke controle, waaronder maar niet beperkt tot: storingen of uitval bij externe providers (inclusief AI- en hostingproviders), internetstoringen, stroomuitval, overheidsmaatregelen, natuurrampen of cyberaanvallen.
Wij kunnen deze Voorwaarden van tijd tot tijd bijwerken. Wezenlijke wijzigingen worden minimaal dertig (30) dagen van tevoren aangekondigd per e-mail of via de Dienst. Indien u niet akkoord gaat met de gewijzigde Voorwaarden, kunt u uw account beëindigen voordat de wijzigingen van kracht worden. Voortgezet gebruik van de Dienst na de ingangsdatum geldt als aanvaarding van de gewijzigde Voorwaarden.
Op deze Voorwaarden is Nederlands recht van toepassing. Geschillen voortvloeiend uit deze Voorwaarden of het gebruik van de Dienst worden uitsluitend voorgelegd aan de bevoegde rechter te Groningen.
Indien enige bepaling van deze Voorwaarden ongeldig of niet-afdwingbaar wordt geacht, blijven de overige bepalingen onverminderd van kracht. De ongeldige bepaling wordt vervangen door een geldige bepaling die de oorspronkelijke bedoeling zo dicht mogelijk benadert.
